Terms of Service
Last updated: 1, 2026
These Terms of Service apply to your use of www.usedexcavator.shop and to quotations and orders for used construction machinery and commercial vehicles provided by Anhui SHUNFA Construction Machinery Co., Ltd. ("SHUNFA," "we," or "us"). Please review these terms before using the website or placing an order.
1. Acceptance of These Terms
By accessing this website or requesting a quote, you confirm that you have read and accept these terms. If you do not agree, please do not use the website or our services.
2. About Us
We are a supplier of used construction machinery and commercial vehicles based in Anhui, China, serving international buyers. If these terms conflict with a written sales contract signed by both parties, the signed contract shall prevail for that order.
3. Equipment Information
Listings describe used equipment, including brand, model, year of manufacture, operating hours, key specifications, and photos. Descriptions are prepared in good faith based on our inspection and available records. Used machines may show wear consistent with prior use; manufacturer specifications are provided for reference only.
Photographs show the actual unit unless the listing states otherwise. Availability is subject to prior sale. We confirm condition, availability, and final specifications in writing before accepting an order.
4. Quotes and Pricing
Quotations are issued in US dollars unless otherwise stated and are valid for 7 days unless noted otherwise. Prices reflect the equipment configuration and destination specified in the quotation. Import duties, destination taxes, port charges, and local fees are not included unless expressly stated. Shipping costs vary based on volume, route, and vessel schedule.
5. Orders and Payments
An order is confirmed once we issue a proforma invoice and receive the agreed deposit. Unless otherwise agreed in writing, payment is made via bank transfer: a deposit upon order confirmation and the balance prior to shipment. The payer bears all bank charges.
We do not accept payments to accounts under names other than the Company name listed on our proforma invoice. Please verify bank details with our office by phone or email before transferring funds.
6. Inspection
You may arrange your own or a third-party inspection before shipment at your own cost, subject to site access. We can provide loading photos and videos of the unit upon request.
7. Shipping and Risk
Delivery terms follow the Incoterms specified in the sales contract, typically FOB or CIF. Risk transfers as outlined in the contract. Loading occurs after receipt of the deposit. Transit time varies based on carrier schedules, port congestion, and customs clearance, which are beyond our control.
8. Export Documents
We provide the commercial invoice, packing list, bill of lading, and certificate of origin for your shipment to facilitate import clearance. Requirements vary by destination; please confirm what your customs authority needs before shipping.
9. Warranty and After-Sales Support
Used equipment is sold in its condition at the time of shipment. Unless the sales contract specifies otherwise, machines include the after-sales commitment outlined in the contract, covering the core components listed for one year. Wear parts, consumables, and damage resulting from improper operation, modification, or use of non-genuine parts are not covered. Warranty claims require photos or video and, if necessary, an inspection.
10. Cancellation and Refunds
Orders may be cancelled before shipment per the sales agreement. Deposits are non-refundable once the unit is reserved or loading is arranged. If we cannot deliver your order, we will provide an equivalent replacement or refund the amount paid.
11. Intellectual Property
The text, photographs, logo, and layout of this website are the property of the Company or its licensors. They may not be copied or used for commercial purposes without our written permission.
12. Limitation of Liability
To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, business interruptions, or delays beyond our reasonable control, including carrier schedules, port congestion, customs inspections, and force majeure events. Our total liability for any claim related to an order is limited to the amount paid for the relevant equipment.
13. Compliance and Export Control
Buyers must comply with all applicable import regulations, sanctions, and end-use requirements in their jurisdiction and obtain any required import licenses or permits.
14. Governing Law and Disputes
These terms and any sales contract are governed by the laws of the People's Republic of China. The parties will first attempt to resolve any dispute through friendly negotiation; if that is not possible, the dispute shall be submitted to the competent court at the Company's domicile.
